Hear me out:

Changes to the The Citizen Initiative Act (CIA) under the amendments proposed in Bill 14, would allow a proposed referendum to be in contravention of the constitution.

Another amendment to the Referendum Act states that Alberta’s government is not required to implement the results of a binding referendum if doing so would contravene Canada’s constitution.

What is disturbing is that I cannot see any requirement specifying that the court must be consulted to decide the constitutionality of a referendum question.

Lord help us if the Minister of Justice is the one who gets to decide. Giving himself that power may put any decision circumventing the courts at odds with professional legal standards. Which would explain the immunity clause.

Also, there has been a fair bit of court-bashing already on the part of the minister. Maybe that's about to ramp up?

Despite the immunity, his decision could still be challenged in court, so at least there's that...

It turns out my fears were warranted.

Smith doesn't want the courts to be involved in deciding constitutionality, says it should be left up to politicians.
