As not a lawyer, it is very weird to me that we have a point-based recommendation system to try to ensure some consistency, that nevertheless regularly gets deviated from (and not by small amounts!). Nor does it really seem to get publicly acknowledged as useless. Why bother, at that point?

As a former prosecutor and defense attorney, a few factors struck me. First, it’s much easier to convince a prosecutor that the man is the ringleader/culprit. Second, it’s a white-collar crime. Prosecutors don’t get excited about property crimes. The enormity of what she must disgorge, $11B, seems to have been negated by the first two factors. Finally, sentencing guidelines can only assist you so far.
